HomeMy WebLinkAbout4000 - Street Lighting System - Tract 1011• 2 3 • 4 7 3 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 RESOLUTION OF INTENTION NO. 4000 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFOR- NIA, DECLARING ITS INTEN- TION TO ORDER CONSTRUC- TION AND INSTALLATION OF A STREET LIGHTING SYS -' TEM IN .TRACT NO. 1011, IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DE- SCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of Newport Beach pursuant to the Provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and highways Code of the State of California, does re- solve as follows: SECTION 1. That the public in- terest and convenience require, and it is the intention of the City Council of the City of Newport Beach, California, to order the fol- lowing work to bb done, to -wit: DESCRIPTION OF WORK FIRST: The construction and installation of a street lighting sys- tem, consisting of cement concrete posts or standards (Marbelite De- sign No. 43 -D4), each equipped with one luminaire, including 2500 lumen incandescent lamps, using 5000 volt Thermoplastic Cable installed in galvanized iron pipe conduit, and appurtenant work in connection therewith; in that certain public EASEMENT owned by the (sty of Newport Beach, over, along and across Lots A, B and C of Tract No. 1011, as per map recorded in Miscellaneous Map Book 36, Pages 37 to 40 in- clusive, Records of Orange County, California. - SECOND: The construction and installation of a 5000 volt Thermo- plastic Cable installed in galvan- ized iron pipe conduit, and appur- tenant work in connection there- with; in the southerly side of the - STATE HIGHWAY adjacent to said Lots A and B of said Tract No. 1011. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done, shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and . drawings for the construction of said improvements in said Tract No. 1011, being Plan No. 435 con- sisting of one (1) sheet on file in the office of the City Engineer, Of said City, and except as other- wise provided on said plans in fur- ther accordance with the Specifi- cations for the construction of §aid Improvements, said Specifications being on file in the office' of the City Clerk of said City, and to which plans, profiles, drawings and specifications heretofore approved by the City Council of the said City, reference is hereby made for a further, full and-more particu- lar description of the said work, and by reference thereto the same are incorporated herein and made a part hereof. - - DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said con- templated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and ex- penses thereof, and which district is described as follows: All that certain territory of the City of Newport Beach, California, • exclusive of streets and alleys, in- cluded within the exterior boun- dary line shown upon that certain Map or Plat No. 435, heretofore approved by the City Council of said City on the 14th day of May, 1951, indicating by said boundary line the extent of the territory in- eluded within the proposed assess- ment district, and which map or plat is on file in the office of the City Engineer, of the said City. Reference is hereby made to said map or plat for a further, full and more particular description of the said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment dis- trict. DESCRIPTION OF BONDS SECTION 4. That serial bonds bearing interest at the rate of six per cent (6 %) per annum shall be issued to represent each assess- ment of Twenty -five D o 11 a r s ($25.00) or more, remaining unpaid for thirty (30) days after the date of recording the warrant. Said serial bonds shall extend over a Period ending nine (9) years from the Second day of January next succeeding the next October fif- teenth following their date. Pay- ments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in 1 • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 the "Improvement Act of 1911 hereinafter referred to. TIME AND PLACE OF HEARING SECTION 5. NOTICE IS HERE- BY GIVEN, that on the 13th day of August, 1951, at the hour of seven - thirty (7:30) o'clock P. M. in the Council Chamber of the City Council, in the City Hall of said City of Newport Beach, any and all persons having any objections to the proposed work or improve- ment, or to the extent of the as- sessment district, or to the pro- posed grades, may appear and show cause why said work should not be done or carried out in ac- cordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 6. That all of the work herein proposed shall be done and carried through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 1911 ", being Division 7 of the Streets and High- ways Code of the State of Calf= forms. PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The "Newport Harbor Ensign ", a weekly newspa- per, printed, published and of gen- eral circulation in the City of Newport Beach, California, is here- by designated as the newspaper in which this Resolution of Inten- tion shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the pro- ceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of, this .Resolution of Intention to all per- sons owning real property pro- posed to be assessed wh69? names and addresses appear on the last equalized assessment roll for City Taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Im- provement Act of 1911 ", of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT SECTIONS. The Superinten- dent of Streets of the City of New- port Beach, shall cause to be con- spicuously posted along the line of said contemplated work or im- provement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. INVESTIGATION REPORT SECTION 9. That the written report of the City Engineer of the City of Newport Beach, on the proposed improvements herein de- scribed and prepared pursuant to the provisions of the "Special As- sessment Investigation, Limitation and Majority Act of 1931 ", being Division 4 of said Streets and Highways Code, is on file in the office of the City Clerk of said City and open to public inspection.. PASSED AND ADOPTED by the City Council of the City of Newport Beach, California, at a regular .meeting. thereof held this 9th day of July, 1951, by the fol- lowing vote, to -wit: AYES, COUNCILMEN: Finch, Ramsey, Greeley, NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None L.
