HomeMy WebLinkAbout4961 - Special Municipal Election 6-2-594/6/c 1p '12 e � e 1 RESOLUTf*N NO. `f6/ • 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF N�JPORT BEACH CALLING A SPECIAL 3 MMUNICIPAL r.LECTION TO BE HELD ON THE 2ND DAY OF JUN:*, 1959, ORDERING THE SUBMISSION 4 OF A PROPOSED INITIATIVE: ORDINANCE TO THE VOTERS FOR CONSIDERATION AND SETTING FORTH 5 THE FORM OF THE BALLOT PROPOSITION AND TTXT OF TIC PROPOSED INITIATIVE ORDINANCE 6 7 %;'Ii=AS, an initiative petition has been filed with the 8 City Clerk on March 26, 1959; and 9 WHEREAS, the City Clerk has ascertained that said petit'io, 10 is signed by not less than 15% of the voters of the City; and 11 .•JHM&AS, said petition contains a request that the City 12 Council submit the proposed ordinance immediately to a vote of the 13 people at a special election; 14 N041 , Ethe City Council of the City of Newport 15 Beach does hereby resolve, declare, determine and order as follows: 16I Section 1. A special municipal election is hereby called 17 and shall be held on Tuesday, June 2, 1959, for the purpose of sub- 18 mitting to the qualified electors a proposed initiative ordinance. 19 Section 2. The polls for said special municipal election 20 to be held on June 2, 1959, shall be open at seven otclock A. M. 21 on the day of election and shall remain open continuously from the 22 time of opening until seven o'clock P. M. of the same day, at whir`_i 23 time said polls shall be closed in accordance with the provisions 24 of Sections 5734 and 5735 of the Elections Code of the State of 25 California. 26 Section 3. The ordinance shall be submitted as Ordinance No. S1 y in the exact form in which it was presented, which is as follows; "ORDINANCE NO. '� q C& AN ORDINANCE PROVIDING FOR THE REGUL.#R COLLECTION, HAULING X.-JAY AND DISPOSAL OF GARBAGE, TRASH, REFUSF, AND GARDEN CUTTINGS AND FOR THE DEFRAYING OF THE COSTS AND MIPENSE OF SUCH C0 `:CTIONS FROM THE P -D VALOJUM TAX REVENUES OF THE CITY OF NE'iJPORT BEACH The people of the City of Newport Beach do ordain as follows: SsCTION 1. The cost and expense of collecting, haul- ing away and disposal of garbage, refuse and cuttings, as those terms are defined by Sections 5201, 5213 and 5203.1 of the Newport Beach Municipal Code, shall be defrayed exclusively from the ad valorem tax revenues of the city of Newport Beach. SECTION 2. That Section 5212.1 of the Newport Beach Municipal Code, added to said Code by Ordinance No. 687, adopted June 8, 1953, be and the same is hereby repealed." Section 5. The City Clerk is authorized and directed to publish notice of said election, to cause the ordinance to be printed and a copy thereof enclosed in an envelope with the sample ballot and mailed to each voter at least ten days prior to the 2. • • • 1 II 2 3' 4' 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 211 i 22 23' 24 25 26 27 28 29 30 31 32 election, to publish a notice of election officers and polling places when established, to prepare sample ballots to be mailed to each registered voter, to prepare polling place cards to be mailed to each registered voter, to publish a synopsis of the measure to be voted on at least twice before the day of the election and to perform such other acts as are necessary to conduct said special election in accordance with law in order to present the proposed initiative ordinance to the qualified electors of the City of Newport Beach.
