RESOLUTION N0, 4966
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH INITIATING AN AMENDMENT TO
ARTICLE IX OF THE NEWPORT BEACH MUNICIPAL CODE
• WHEREAS, uncertainty exists as to the proper interpreta-
tion of Sections 9103.34 and 9107.28 of the Newport Beach Municipal
Code relating to the height of buildings; and
WHEREAS, it appears necessary to amend said sections in
order that they may be interpreted in accordance with the intent
of the City Council when they were initially enacted; and
WHEREAS, the Newport Beach Municipal Code provides that
amendments may be initiated by resolution of intention of the City
Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby suggests clarifying language to amend Sections 9103.34
and 9107.28, as follows:
"Section 9103.34. Building Height Limit:
(a) For main buildings -- a maximum of three (3)
stories not exceeding thirty -five (35) feet,
provided that the stories and height may be
increased to a maximum of seven.(7) stories
and seventy -five (75) feet upon the obtaining
of a use permit in each case.
(b) For accessory buildings -- maximum fifteen (15)
feet."
"Section 9107.28. 'HEIGHT OF BUILDINGS'. The
vertical distance from the average level of the highest
and lowest point of that portion of the lot in its
natural state covered by the building and its projec-
tions to the topmost point of the roof."
BE IT FURTHER RESOLVED that a copy of this resolution
be forwarded to the Planning Commission and the Planning Commission
is hereby requested to process the proposed amendment and make a
report of its findings and recommendations to the City Council.
This resolution was adopted by the City Council of the
• City of Newport Beach at a regular meeting on the 13th day of
April;, 1959•,,, by the following vote, to wit:

-- Kingsley, Atkinson, Stoddard
NOES, COUNCILMEN: Higbie

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
