(12) V 1 RESOLUTION N0, 'f9,71 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NE' ?PORT BEACH ORDERING THE VACATION, CLOSING 3 UP AND ABANDONMENT OF PORTIONS OF A CERTAIN STREET I0TOrJN AS OCEAN FRONT 4 5 WHEREAS, the City Council of the City of Newport Beach 6 did, on the 23rd day of March, 1959, pass its certain Resolution 7 of Intention No. 4955, declaring its intention to order the 8 vacation, closing up and abandonment of portions of a certain 9 street known as Ocean Front in the City of Newport Beach, herein - 10 after more particularly described, pursuant to and in accordance 11 with the "Street Vacation Act of 1941 ", and all amendments thereto, 12 being Sections 8300 to 8331, inclusive, of the Streets and High - 13 ways Code of the State of California; and 14 I(THEREAS, the Street Superintendent of the City of Newport 15 Beach has caused to be posted conspicuously along the line of the 16 portiors of said street proposed to be vacated, not more than 300 17 feet apart, and not less than three in all, notices of the vacation 18 of said portions of said street, all of which will more fully ap- 19 pear from the affidavit of L. W. Covert, Street Superintendent of 20 the City of Newport Beach, on file in these proceedings; and 21 WHEREAS, said notices so posted by the Street Superin- 22 tendent of the City of Newport Beach stated the passage of said 23 Resolution of Intention No. 4955 aforesaid, and the time and place 24 of the hearing of all persons interested in or objecting to the 25 proposed vacation of said portions of said street; and 26 TATHERF,AS, the City Council of the City of Newport Beach 27 did set Monday, April 27, 1959, at 7:30 P. M. of said day as the 28 time, and the Council Chamber of the City Council of the City of 29 Newport Beach, located in the City Hall of the City of Newport Beac 30 as the place, for the hearing of all persons interested in or ob- 31 jetting to the proposed vacation of said portions of said street; 32 and V 0 Ah MW • 6 7 8 9 10' 11 12 13i 14 15', 16' 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 `M r 1M- W2EAS, said Resolution of Intention No. 4955 aforesaid has been published at least once in the Newport Harbor Ensign, a newspaper of general circulation, printed, published and circu- lated in the City of Newport Beach, and said publication was made more than 15 days prior to the date set for the hearing of all persons interested in or objecting to the proposed vacation, all of which will more fully appear by the affidavit of Arvo F. Haapa, owner and publisher of said Newport Harbor Ensign, on file in these proceedings; and 1,HEREAS, the City Council of the City of Newport Beach has heard the evidence, both written and verbal, of all persons interested in the vacation of said portions of said street in this resolution more particularly hereinafter described, and finds from all the evidence submitted that said portions of said street described in said Resolution of Intention,.and hereinafter described, are unnecessary for present or prospective public street purposes; NOW, THFUREFORE, the City Council of the City of Newport Beach finds and determines and hereby orders that the following described portions of that certain street known as Ocean Front in the City of Newport Beach, to wit: Portions of that certain street, Ocean Front, in the Seashore Colony Tract as said Ocean Front is laid out and shown upon a map recorded in Miscellaneous Map Book 7, page 25, Records of Orange County, California, and more particularly described as follows, to -wit: Beginning at the most southerly corner of Lot No. 6, Block F of Seashore Colony Tract as said tract is shown upon a map recorded in Miscellaneous Map Book 7, page 25, records of Orange County, California; thence northwesterly along the southwesterly line of said lot No. 6 to the most westerly corner of said Lot No. 6; thence southwesterly along the southwesterly prolongation to the northwesterly line of said Lot No. 6 to an intersection with a line lying southwesterly of, parallel to, and distant 15 feet from the southwesterly line of said Lot No. 6; thence southeasterly along said parallel line to an intersection with the south- westerly prolongation of the southeasterly line of said Lot No. 6; thence northeasterly along said southwesterly prolongation to the point of beginning; and 2. i El • • 1 I Beginning at the most southerly corner of Lot No. 4, Block B of Seashore Colony Tract as said tract is shown 2 upon a map recorded in Miscellaneous Map Book 7, page 25, records of Orange County, California; thence northwesterly 3 along the southwesterly line of said Lot No. 4 to the most westerly corner of said Lot No. 4; thence southwesterly 4 along the southwesterly prolongation to the northwesterly line of said Lot No. 4 to an intersection with a line lying 5 southwesterly of, parallel to, and distant 15 feet from the southwesterly line of said Lot No. 4; thence southeasterly 6 along said.parallel line to an intersection with the south- westerly prolongation of the southeasterly line of said 7 Lot No. 4; thence northeasterly along said southwesterly prolongation to the point of beginning, 8 9 are unnecessary for present or prospective public street purposes, 10 and that they be vacated, closed up and abandoned. 11 The City Council further finds and determines, and it 12 is hereby ordered, that the public easement in the portions of 13I said street as heretofore described has, upon the passage of this 14 resolution, ceased. 15 The City Council further orders that the City Clerk of 16 the City of Newport Beach shall cause a certified copy of this 17 Order, duly attested by her as the City Clerk, under the seal of 18 the City, to be recorded in the office of the County Recorder of 19 the County of Orange, State of California, immediately following 20 the passage of this resolution. 21 This resolution was adopted by the City Council of the 22 City of Newport Beach at a regular meeting on the 27th day of 23 April, 1959, by the following vote, to wit: 24 AYES, COUNCILMEN: - �,.rz 26 NOES, COUNCILMEN: kA ^ v 27 _ '; ABSENT COUNCILMEN: 28 29 30 31 32 A�S`P City Clerk - -/A_1 /' Mayor .0 STATE OF CALIFORNIA ) COUNTY OF ORANGE ) SS CITY OF NEWPORT BEACH ) I, MARGERY SCHROUDER, City Clerk of the City of Newport Beach, California, do hereby certify that according to the records of the City of Newport Beach filed and maintained in my office, the foregoing Resolution Noy 4971 was duly and regularly adopted, passed, and approved by the City Council of the City of Newport Beach, California, at a regular meeting of said City Council held at the regular meeting place thereof, on the 27th day of April 9 1959, by the following vote, to wit: AYES, COUNCILMEN: Hart, Lorenz, Somers, Kingsley, Atkinson, Higbie, Stoddard NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Dated this 28th day of April v �9 59, 'N City Clerk nd Ex- Offic1o�Clerk of the City Council, City of Newport Beach, State of California. %i
