HomeMy WebLinkAbout4989 - Curb Painting of Pacific Coast HighwayWWC:me 4/27/5 (12) 1 RESOLUTION NO. 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE PAINTING.OF 3 A PORTION.OF THE CURB ALONG THE SOUTH SIDE OF PACIFIC COAST HIGHWAY BETWEEN THE SOUTHERLY 4 EXTENSION OF.RIVERSIDE.AVENUE AND TUSTIN AVENUE 611 WHEREAS, traffic and parking conditions on Pacific Coast 7 Highway between Riverside Avenue and Tustin Avenue are such that 8 painting of the curb as hereinafter described would be advantage 9 and 10 WHEREAS, Section 589.5 of the Vehicle Code provides that 11 local authorities may by resolution restrict the parking of vehicl, 12 on a state highway if such resolution is first submitted to and 13 approved in writing by the Department of Public Works; and 14I WHEREAS, the proposed painting would constitute a restri 15I tion on the parking of vehicles; 16 NOW, THEREFORE, BE IT RESOLVED: 17 Section 1, It is directed that the curb adjacent to 18 one parking space along the south side of Pacific Coast Highway 19 between the southerly extension of Riverside Avenue and Tustin 20 Avenue be painted red to indicate no parking, and that the curb 21 adjacent to two parking spaces at said location be painted white 22 to indicate a passenger loading zone, all as shown on drawing No. 23 L -2776 dated 4- 22 -59, entitled "City of Newport Beach Proposed 24 Removal of Parking Meters ". 25 Section 2. The provisions of this resolution shall be 26 effective only after written approval by the Department of Public 27 Works of the State of California. 28 The regulation of traffic hereby established upon the, 4,W` 29 state highway shown on said drawing attached hereto shall cease to 30 be operative six (6) months after receipt by the City Council of 31 written notice of withdrawal of approval by the Department of Publi 32 Works. I Whenever this resolution authorizes action by any City 2 officer or employee to regulate traffic upon a state highway in 3 any way which by state law requires the prior approval of the 4 Department of Public Works, no such officer or employee shall 5 exercise authority or take action with respect to any state high - 6 way without the prior approval in writing of the Department of 7 Public Works when and to the extent required by Division 9 and 8 Division 11 of the Vehicle Code. 9 This resolution was adopted by the City Council of the 10 City of Newport Beach at a regular meeting on the 27th day of 11 April, 1959, by the following vote, to wit: 12 AYES, COUNCILMEN: 13/ 14 _ - NOES, COUNCILMEN: 5 15 ABSENT COUNCILMEN: 16 ATTEST: 17 (k 18 City Cler 19 ayor 20 21 22 23 24 25 26 27 28 29 30 31 32 2. v - i 7 5 T n A�- T st "z r.
