RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN

AGREEMENT BETWEEN DIKE AND COLEGROVE, A CALIFORNIA
•
PARTNERSHIP,.AND THE CITY OF NEWPORT BEAC`i FOR THE

CONSTRUCTION OF IMPROVEMENTS IN TRACT NO. 3379

WHEREAS.. there has been presented to the City Council of
7
the City of Newport Beach an agreement wherein Dike and Colegrove,
8
a California partnership, subdivider of Tract No. 3379, agrees to
9
construct street and other public improvements within and such as
10
are necessary to serve said subdivision, to wit: water lines,
11
sewer system, grading, streets, curbs, gutters, street lighting
12
system, installation of base material, asphalt plant mix and prime
13
coat, sidewalks, street trees and any other improvements necessary
14
to serve said subdivision as approved by the City Engineer; and
15
WHEREAS, said agreement provides that Dike and Colegrove
16
shall file with the City of Newport Beach a surety bond to assure
17
faithful performance of said agreement;
18
NOW, THEREFORE, BE IT RESOLVED that said agreement betwe
19
Dike and Colegrove and the City of Newport Beach in which Dike and
20
Colegrove agrees to construct the improvements in Tract No. 3379
21
be approved and the Mayor and City Clerk are hereby authorized and
22
directed to execute the same on behalf of the City of Newport
23
Beach at such time as Dike and Colegrove files with the City said
24
surety bond and said bond is approved by the City Manager as to
25
sufficiency and the City Attorney as to form.

This resolution was adopted by the City Council of the
27
City of Newport Beach at a regular meeting on the 25th day of May,
