2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DIRECTING THE ACCEPTANCE OF
3 A DEED FROM THE IRVINE.COMPANY CONVEYING
CAPACITY RIGHTS IN A CERTAIN PIPELINE

511 WHEREAS, The Irvine Company under a contract dated May
6 15, 1952, with Laguna Beach County Water District and South Coast
7 County Water District recorded in Book 2336, page 528, of Official
8 Records in the office of the Recorder of Orange County, California,
9
owns capacity rights in a pipeline extending from Fernleaf Avenue
10
in Corona Del Mar
southeasterly to Laguna Beach,
making water
11
available to lands
of The Irvine Company; and
12
WHEREAS,
The Irvine Company has caused
a portion of said
13
lands to be annexed
to the City of Newport Beach
which are being
14
developed as Tract
No. 3357, the map of which is
recorded in Book
15
107, pages 1 to 7,
of Miscellaneous Maps, Records
of Orange County
16
California; and
17 IIHFREAS, The Irvine Company has tendered a deed to the
18 City of Newport Beach conveying 8.04% of the 34.94% capacity of
19 said line available to serve Irvine lands adjoining said pipeline
20 in the vicinity of said tract; and
21 WHEREAS, said deed provides that this capacity is grant
22 and conveyed to the City of Newport Beach for the purpose of sup -
23 plying domestic water to said Tract No. 3357 subject to the obli-
24 gation to pay the proportionate cost of repairs, replacements and
25 operation thereof; and
26 WHEREAS, the terms of said deed are fair and equitable
27 the capacity is necessary for the City to serve this area of the
28 City with water;
29 1 NOW, THEREFORE, BE IT RESOLVED that the deed be accepted
30 and the City Clerk be authorized and directed to execute and
31 attach a certificate of acceptance and consent to the recording of
32 said deed in the County Recorder's office.

This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting on the 8th day of June,
19590 by the following vote, to wit:

of the City of Newport Beach filed and iaaintained in my office,
the foregoing Resolution No. 5030 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
