2 A RESOLUTION OF THE CITY COUNCIL OF THE rITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
3 AN AGREEMENT 14ITH NWPORT HEIGHTS IRRIGATION
DISTRICT

5 1,1HEREAS, the City Council by Resolution No. 5016 author -
6 ized and directed that a petition be filed seeking the exclusion
7 of the Cliff Haven area of the City from the Newport Heights
8 Irrigation District; and
911 t^.r=AS, in connection with the exclusion of this area
10 from the District it is necessary that the City take over the
11 distribution facilities of the District in said area; and
12 lq=AS, it is in the interest of both parties to provide
13 by written contract the terms and conditions under which the City
14 will take over the distribution facilities and serve the area with
15 water; and
161 WHEREAS, a contract has been prepared and executed by the
17 Newport Heights Irrigation District and presented to the City
18 Council in which the District agrees to turn over title, control
19 and possession of said facilities, to obtain the consent of the
20 bondholders to the exclusion of the area from the District, and to
21 hold harmless and indemnify the City against obligations arising
22 prior to the exclusion, and in which the City agrees to serve the
23 residents with water, pay the expense of giving notice and of the
24 proceedings for exclusion and pay the sum of $17,700 to the
25 District for the property and the area's share of the bonded in-
26 debtedness; and
27 IATHEREAS, the terms of the agreement are fair and in the
28 interest of both parties and in the public interest;
29 NMT, THEREFORE, BE IT RESOLVED that the Mayor and City
30 Clerk be and are hereby authorized to execute said agreement on
31 1 behalf of the City.

Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No. 5046 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 22d day of June 9 19599 by the following
vote, to wit:
AYES, COUNCILMEN: KinQslev, Atkinson, Higbie, Stoddard,
Hart, Lorenz, Somers.
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
