2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE.EIMCUTION OF A
3 NOTICE OF ADDITION OF TERRITORY.FOR,TRACTS NOS.
5877 ,AND 6227..UNDER THE DECLARATION OF COVENANTS,
4 CONDITIONS AND.RESTRICTIONS APPLICABLE TO TRACTS
NOS._5463, 5480, AND,OTHERS

6 WHEREAS, the City of Newport Beach has previously exe-
7 cuted Covenants, Conditions and Restrictions applicable to Tracts
8 Nos. 5463, 5480, 5435, 5692, 5740, 5741, and 5878; and
9 I-JHEREAS, final subdivision maps have been approved for
10 Tracts Nos. 5877 and 6227 which adjoin Tracts Nos. 5435 and
11 5463; and
12 WHEREAS, said Tracts Nos. 5877 and 6227 are portions of
13 the planned residential development approved by Use Permit No.
14 1054(E); and
15 WHEREAS, Declarant has submitted to the City a "Notice
16 of Addition of Territory" in connection with Tracts Nos. 5877 and
17 6227 which will subject said tracts to the above mentioned
18 Declaration of Covenants, Conditions and Restrictions; and
19 WHEREAS, said Covenants, Conditions and Restrictions
20 provide for the approval of the City to be endorsed on said
21 notice;
22 NOW, THEREFORE, BE IT RESOLVED that the Notice of
23 Addition of Territory is approved by the City, and the Mayor and
24 City Clerk are authorized and directed to execute said notice on
25 behalf of the City.
