2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE E)MCUTION OF
31 SUPPLEMENTAL AGREEMENT NO. 3014 S -1 WITH THE
STATE OF CALIFORNIA

• 5 WHEREAS, the City of Newport Beach and the State of
6 California recently entered into Cooperative Agreement No. 3014
7 for the construction and maintenance of certain improvements on
8 State -owned rights of way adjacent to West Coast Highway between
9 59th Street and the Santa Ana River; and
10 WHEREAS, the City desires to change the 6 -foot chain
111 link fence mentioned in said agreement to a location behind the

1211 landscaped area and is willing to maintain said fence because
13 of relocation; and
14 WHEREAS, there has been presented to the City Council
15 Supplemental Agreement No. 3014 S -1 between the City and the State
16 which would accomplish the desired changes; and
17 WHEREAS, the City Council has considered the terms and
18 conditions of said agreement and found them to be reasonable and
19 equitable;
20 NOW, THEREFORE, BE IT RESOLVED that said agreement is
21 approved and the Mayor and City Clerk a-re hereby authorized and
22 directed to execute the same on behalf of the City of Newport
23 Beach.
