HomeMy WebLinkAbout6631 - Private Roads Open for Public UseTImec 8flg4/67 (12) l� 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. -LLU_ A RESOLUTION OF TFM CITY COUNCIL OF THE CITY OF NEWPORT BEACH FINDING AND DECLARING THAT CERTAIN PRIVATE ROADS OPEN FOR PUBLIC.USE IN THE NEWPORT CENTER AREA OF THE CITY SHALL BE SUBJECT TO THE Ti2AFFIC REGULATIONS CONTAINED IN THE CALIFORNIA VEHICLE CODE. G S, it is anticipated that the Newport Center, a commercial shopping center in the City of Newport Beach, will be open to vehicular traffic prior to the time that the City will formally accept the roads located therein as public streets; and 10EAS9 the roads in Newport Center are connected with public streets in such a manner that the public cannot determine that such roads are not public streets; and MEME S, Section 21107.5 of the California Vehicle Code authorizes a city to enact a resolution making the traffic regula- tions contained in the California Vehicle Code applicable to private roads within the city that are generally held open for use of the public for purposes of vehicular travel and which connect with public streets; and VTHEREAS, the City Council has held a public hearing on the question of whether the provisions of the Vehicle Code should be made applicable to said private roads; and WHEREAS, the owner of the property has consented to the adoption of this resolution; NOt3, THEREFORE, BE IT RESOLVED that the City Council hereby finds, declares and orders as follows: 1. The following described private roads are generally held open for use of the public for purposes of vehicular travel and are so connected with public streets and highways that the public cannot determine that such roads are private: (a) Newport Center Drive (b) Newport Center Drive East (c) Newport Center Drive West 1! (d) Santa Cruz Drive 2 (e) Santa Rosa Drive � 3 (f) San Joaquin Hills Road, between Jamboree Road -and MacArthur Boulevard 4 • 5 I (g) San Miguel Drive (h) San Nicolas Drive 61 7I 2.
