HomeMy WebLinkAbout6667 - Assessment District 50 - Balboa Island Street Lighting District-'a �J81eC �- •• 1/'2/67 (12) 11 RESOLUTION N0, 6667 2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS 3 INTENTION TO ORDER AN IMPROVEMENT CONSISTING OF THE INSTALLATION OF.ADDITIONAL STREET LIGHTS 4 AND APPURTENANCES IN ASSESSMENT DISTRICT NO. 50 5 SETTING THE TIME LIGHTING DISTRICT) AND 61 7 WHEREAS, on the 25th day of October, 1965, the City 8 Council adopted Resolution No. 6236 which established Assessment 9 District No. 50 (Balboa Island Street Lighting District) pursuant 10 to the provisions of the Street Lighting Act of 1919, Division 14, 11 Part 1 (commencing with Section 18000) of the Streets and Highways 12 Code of the State of California, and ordered that certain improve - 13 ments consisting of street lights and appurtenances be installed 14 within said district; and 15 WHEREAS, on the 23rd day of October, 1967, the City 16 Council received a preliminary report concerning the proposed 17 installation of additional street lights and appurtenances within 18 Assessment District No. 50, which report was approved by the City 19 Council without modification; and 20 WHEREAS, the City Council hereby finds that the public 21, interest and convenience require the installation of additional 22 .street lights and appurtenances within Assessment District No. 50 23 in accordance with the proposal set forth in the preliminary 241 report submitted by the Public Works Director; 25j NOW, THEREFORE, the City Council of the City of Newport 26 Beach does hereby resolve and order as follows: 27 1. The City Council hereby declares its intention to 28 order the proposed improvement which is described as the installa- 29 tion of 25 incandescent street lights and appurtenances in the • 30 alleys of Balboa Island in the City of Newport Beach which, to- 31 gether with the incandescent street lights and appurtenances 321 previously installed pursuant to Resolution No. 6236 adopted by • • L T 1 the City Council on October 25, 1965, are shown on the drawing 2 marked Exhibit "A- 1"'vhich is attached hereto and by this reference 3 incorporated herein. 4I 2. The said improvement shall proceed in accordance i 51i with and under the terms and conditions of the Street Lighting Act 6I� of 1919, Division 14, Part 1 of the Streets and Highways Code of 7I the State of California. 81 3. The boundaries of the assessment district shall 911 remain identical with the boundaries of Assessment District No, 10 50 as said district was originally established. 111 4. If any lots or parcels of land owned by the City of 12 Newport Beach are included within the proposed assessment district, 13 this City Council hereby declares its intention that all of such 141 land shall be omitted from the assessment hereafter to be made to 15 cover the costs of said improvement. 16 5. The improvement hereinabove described shall be for 171 a period of eighteen (18) years. 181 6. Monday, the 11th day of December, 1967, at the hour 19 of 7:30 P.M., be and the same hereby is fixed as the day and hour 20� when all interested persons having filed a written protest may 21 appear at the Chambers of the City Council of the City of Newport 22 Beach, located at 3300 West Newport Boulevard, Newport Beach, 231 Orange County, California, and show cause why the City Council 2411 should not order the proposed improvement to proceed. 251 7. Notice of the hearing hereinabove provided for shall 261, be given as follows: 27 (1) The Public Works Director is hereby directed 281 to cause to be posted along all streets in the district where 29 the improvement is proposed to be made or which is to be 30 assessed for the benefits thereof, at not more than three 31 hundred feet apart, but not less than three in all, notices 32 of the passage of this resolution. The notice shall: 2. n U • 1 (a) be headed "notice of improvement ". in 2� letters of not less than one inch in height; 3 (b) in legible characters state the fact and 4 date of the filing of the report and the passage of the 5� resolution of intention; 6� (c) state the date, time and place fixed for 7 the hearing of protests; 8i (d) briefly describe the improvement proposed 91 to be made and refer to the resolution of intention and 10 report for further particulars. 11 The posting of the notices shall be completed at least ten 12 (10) days prior to the date fixed for hearing. 13 (2) The City Clerk is hereby directed to cause a 141 notice, similar in substance to the notice above described, 15) to be published by two successive insertions in the Newport 16 harbor Ensign, such publication to be completed at least ten 17 (10) days prior to the date set for the hearing of protests. 18 3. Any interested person who objects to the proposed 19i improvement or to the assessment therefor may file a written 20 protest, stating his objections thereto, with the City Clerk at or 21 before the hour set for the hearing of protests.
