HomeMy WebLinkAbout6674 - Local EmergencyTHS :mec 11/30/67 RESOLUTION N0, 6674 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH FINDING AND DETERMINING THAT A LOCAL EMERGENCY EXISTS WHICH CONSTITUTES A STATE OF LIMITED PERIL, CONFIRMING THE ACTION OF THE MAYOR AND CITY MANAGER IN PROCLAIMING A STATE OF LOCAL • EMERGENCY, EXPRESSING GRATITUDE TO THE BOARD OF SUPERVISORS OF ORANGE COUNTY FOR THEIR ASSISTANCE, AND REQUESTING THAT THE COUNTY OF ORANGE CONTINUE TO PROVIDE ASSISTANCE FOR THE DURATION OF THE EMERGENCY WHEREAS, the public beach in the western part of the City of Newport Beach has undergone severe erosion during the past several years despite repeated efforts by the City and the County of Orange to replenish said public beach; and WHEREAS, during the past few weeks the erosion'process has reached a point that houses located adjacent to the beach are in imminent danger of destruction; and WHEREAS, emergency measures are essential for the pro- tection of life and property in the threatened area; and WHEREAS, Chapter 2.20 of the Municipal Code establishes procedures for meeting local disasters and emergencies and autho- rizes the City Manager in his capacity as Director of Civil Defense and Disaster to proclaim the existence or threatened existence of a public disaster if the City Council is not in session, subject to confirmation by the City Council at the earliest practicable time; and WHEREAS, on November 29, 1967, the Mayor and City Man- ager of the City of Newport Beach proclaimed that a state of local emergency and threatened disaster exists in the City as a result of the threat to life and property caused by the ero- sion of the beach and requested that the County of Orange make available personnel, supplies and equipment to aid the City in dealing with said local emergency; NOW, THEREFORE, BE IT RESOLVED: 1, The City Council hereby finds and determines that a local emergency exists in the City as a result of the continued erosion of the public beach in the western part of the City and that in the judgment of the City Council this condition consti- tutes a limited peril within the meaning of that term as defined in Section 31,022 of the Codified Ordinances of the County of Orange, 20 The City Council hereby ratifies and confirms the action of the Mayor and City Manager taken on November 29, 1967, whereby said officials proclaimed that a state of local emergency and threatened disaster exists in the City and requested assis- tance from the County of Orange, 3.
