A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT AND EASEMENT FOR
DEPOSIT OF STORM AND.OTHER SURPLUS WATERS
6 FIMEAS, William J. Cagney, a single man, as to an un-
divided one -half interest, and James Cagney as Trustee as to the
remainder; Morgan A. Stivers, a married man, as his sole and
separate property; Newport Medical Corporation, a California
corporation; as Owners, have executed and delivered to the City
of Newport Beach a Grant and Easement for Deposit of Storm and
Other Surplus 47aters which grants to the City certain drainage
pipes shown on Exhibit "A" attached thereto for purposes of
depositing storm and other surplus waters, together with a sub-
surface easement in, under, over and around said drainage pipes,
for the purpose of repairing and maintaining said pipes, which
easement is described as follows:
All that certain land situated in the State of
California, County of Orange, City of Newport Beach,
described as follows:
That portion of Parcel No. 1, as shown on a
map filed in Book.l. Page 35 of Parcel Maps
in the Office of the County Recorder, Orange
County, California, and that portion of Parcel
No. 23, as shown on a map filed in Book 7, Page
38 of Parcel Maps in the Office of the County
Recorder, Orange County, California, and that
portion of Lots A and B as shown on a map
filed in Book 9, Page B of Parcel Maps in the
Office of.the County Recorder, Orange County,
California and that portion of Lot 169 in
Block 2 of Irvinets Subdivision as shown on
a map recorded in Book 1, Page A8 of Miscel-
laneous Record Maps, Records of Orange County,
California, being a strip of land 10.00 feet
wide, the center line of which is described
as follows:
PARCEL NO, 1: Beginning at a point on the center
line o Superior Avenue, as shown on said Parcel
Map 9 -19, distant South 39° 591 4187 West 295.00
feet from its intersection with the center line
of Placentia Avenue, as shown on said Parcel Map
9 -19; thence South 560 53' 317' East 48.35 feet;
thence South 50° 00r 191' cast 109.60 feet to
Point A; thence South 130 22t 49" East 475.59
feet.

feet to the Northeasterly line of said Lot A.
The side lines of said 10 foot strip are to be
prolonged or shortened to terminate Northeasterly
in said Northeasterly line of Lot A and to term-
inate Northwesterly in said center line of
Superior Avenue,
SUBJECT TO: All Covenants, Rights, Rights of
Way.and Easements of Record;
and
VMEREAS, said Grant and Basement contains further pro-
visions with regard to surface access to the pipes and liability
for damages arising out of the use of the drainage easement and
any drainage pipes, facilities and appurtenances contained therein;
as more particularly set forth therein; and
MEREAS, it is to the interest of the City to accept
said Grant and Easement;
NOW, TM=,F'CRE, BE IT RESOLVED that said Grant and
Easement for Deposit of Storm and Other Surplus Waters is hereby
accepted and the City Clerk is authorized and directed to execute
and attach thereto a certificate of acceptance and consent to its
recording and to record said document in the County Recozderis
office.
ADOPTED this 11th day of December, 1967.

do hereby certify that according to the records of the City of Newport Beach
filed and maintained in my office, the foregoing Resolution No. 6681 was
duly and regularly adopted, passed, and approved by the City Council of the
City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 11th day of December 1967,
by the following vote, to wit:
AYES, COUNCILMEN: Parsons, Marshall, Gruber, Cook, Shelton
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: Rogers, Forgit
