I e TITLE: Marine Avenue Business Improvement District FY 2012 -2013 Annual Report ABSTRACT: The Marine Avenue Business Improvement District (Marine Avenue BID) Advisory Board has submitted the BID's FY 2012 -2013 annual report for City Council approval. This is the final, annual report for the Marine Avenue BID as it will be disestablished effective June 30. 2013. RECOMMENDATION: 1. Receive, approve and file the FY 2012 -2013 Annual Report of the Marine Avenue Business Improvement District. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. Marine Avenue Business Improvement District FY 2012 -2013 Annual Report June 25, 2013 Page 2 DISCUSSION: The Marine Avenue BID was formed pursuant to the Parking and Business Improvement Area Law of 1989, codified in California Streets and Highways Code Sections 36500 et seq. (Act), for the purpose of financing activities and programs to benefit businesses located and operating in the territory of the BID. The Marine Avenue BID's territory encompasses the 200 and 300 blocks of Marine Avenue on Balboa Island. California Streets and Highways Code Section 36533 requires the Marine Avenue BID Advisory Board to prepare and submit the attached annual report (Attachment A) for the Council's review and approval. The report includes a summary of the BID's FY 2012 — 2013 accomplishments. This will be the final annual report submitted by the Marine Avenue BID as it is scheduled to be disestablished on June 30, 2013. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers this item). Marine Avenue BID FY 2012 -2013 Annual Report Attachment A MARINE AVENUE BUSINESS IMPROVEMENT DISTRICT FISCAL YEAR 2012 -2013 ANNUAL REPORT This is the annual report for the seventeenth year of the Marine Avenue Business Improvement District. As required by Section 36533 of the California Streets and Highways Code, the annual report shall contain the following information: 1) Proposed Changes to the District Boundary There are no changes proposed to the district boundaries as the Marine Avenue Business Improvement District will be disestablished effective June 30, 2013 pursuant to Ordinance No. 2013 -12, adopted by the City Council May 28, 2013. 2) Improvement and Activities for the Fiscal Year of July 1, 2013 to June 30, 2014 Not applicable. 3) The Cost of These Activities Is Projected as Follows: Not applicable. 4) The Method and Basis of Levying the Assessment Shall be as Follows: There will be no future levies following the disestablishment of the BID. 5) Surplus Carryover from Fiscal Year 2012 -2013 In accordance with California Streets and Highways Code Section 36551, any remaining revenues derived from the levy of assessments or any revenues derived from the sale of assets acquired with the revenues shall be refunded to the owners of the businesses operating within the BID that are current in their annual assessment by applying the same method and basis that was used to calculate the assessment levied this fiscal year. Any BID assets (such as street furniture, holiday decor, the website) must be sold or donated to a nonprofit organization prior to the BID's disestablishment. On April 29, 2013, the Marine Avenue BID Board voted in favor of donating the BID's assets located in the public right of way to the City of Newport Beach and all other assets to the Balboa Island Improvement Association. 6) Sources of Contributions Other Than Levied Assessments Not applicable. 7) Past Year Accomplishments The Marine Avenue BID instituted and completed the following projects and initiatives during FY 2012 -2013: o The BID initiated a redesign of the website, www.balboa - island.net, which includes enhanced merchant listings and a calendar highlighting all Balboa Island community events. The successful, BID- sponsored, Monster Bash fall concert was well attended and featured live music and autumn - themed activities for several hundred visitors. C The BID continued its holiday decor and lights program as well as banner programs, highlighting holiday seasons, promoting special events and creating a sense of place. The BID also replaced custom patriotic flags on Marine Avenue. O The BID supported the efforts of the Balboa Island Improvement Association and Newport Beach & Company in promoting community events. o The BID supported the Balboa Island Improvement Association's annual Balboa Island Parade and after -party. A comprehensive blend of community and visitor advertising contributed to the success of businesses in the District. The BID advertised in the Orange County Register and other local publications to reach area residents. The District was also represented in county and regional marketing through its partnerships with Newport Beach & Company and the Anaheim/Orange County Visitor and Convention Bureau. The merchants of the Marine Avenue BID want to thank the City Council and City of Newport Beach for their financial support and efforts on behalf of the BID for the past seventeen years. 1)
