HomeMy WebLinkAbout9550 - Assembly Bill 951RESOLUTION NO. 95,50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH EXPRES13ING ITS SUPPORT FOR ASSEMBLY BILL NO. 951 WHEREAS, the State of California has invested approximately $4.6 million in the acquisition, preservation and enhancement of the Upper Newport Bay and the State Depart- ment of Fish and Game manages it as an ecological reserve thereby recognizing its significance and value as a habitat for fish and wildlife including several rare or endangered species; and WHEREAS, the influx of sediment into Upper Newport Bay poses a major immediate danger to this valuable resource; and WHEREAS, the structural solutions in the form of down- stream sil retention basins and upstream on -site siltation reten- tion methods are required to prevent the influx of siltation into Newport Bay; and WHEREAS, Assembly Bill No. 951 has been introduced by Assemblywoman Marian Bergeson, 74th Assembly District, which provides funding for the immediate study of downstream structural solutions to the Upper Newport Bay siltation problem with the intent that, based upon the results of such studies, further funding would be sought the following year for design and construction of specific downstream desiltating facilities; and WHEREAS, the bill should also include funds for study of on -site silt retention; and • WHEREAS, Assembly Bill No. 951 has been set aside for hearing by the Committee on Water, Parks, and Wildlife on April 25, 1979, NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve, determine, and order as follows: SECTION 1. That the City Council of the City of Newport Beach hereby expresses its support for Assembly Bill No. 951, provided that the bill include funds for the study of upstream siltation sources for the purpose of establishing means of on -site silt control; and SECTION 2. That a certified copy of this resolution be transmitted to each member of the Committee on Water, Parks, and Wildlife prior to the date set: for hearing thereon and to Assemblywoman Bergeson and Senator John G.
