HomeMy WebLinkAbout9670 - Vacation & Abandonment of Acacia StreetB,,K /3'�zy ?,&,e lkz 00 /n/srz r �16y7 RESOLUTION NO. 9670 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF ACACIA STREET RIGHT -OF -WAY SUBJECT TO CONCURRENT ACTION BY THE COUNTY OF ORANGE ON THE WESTERLY PORTION OF RIGHT -OF -WAY (Easterly Side from Irvine Avenue to Orchard Drive) WHEREAS, the Public Works Director of the City of Newport Beach presented to the City Council of the City of Newport Beach on October 9, 1979, a certain map prepared by the Public Works Department dated August 14, 1979, and entitled "Portion of Acacia Street to be Vacated," drawing No. R /W- 5418 -L, which the City is considering vacating; and WHEREAS, the City Council of the City of Newport Beach approved and adopted said map on October 9, 1979, and directed the City Clerk to file same in the proceedings for the abandonment of said portion of Acacia Street on the easterly side from Irvine Avenue to Orchard Drive; and WHEREAS, on November 12, 1979, the City Council held a public hearing for the purpose of hearing all persons interested in or objecting to the proposed vacation and aban- donment of said above - described portion of Acacia Street; and WHEREAS, the City Council finds and determines from all of the evidence submitted that the subject portion of Acacia Street described herein and more particularly in Resolution No. 9648 is unnecessary for present or prospective public use, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that. said portion of Acacia Street more particularly described as That portion of the southeasterly 30.00 feet of Acacia Street, 60.00 feet wide, as shown on a map of Tract No. 706, recorded in Book 21, Page 25, of the Miscellaneous Maps, in the Office of the Recorder of the County of Orange, California, described as follows: s That portion of the southeasterly 30.00 feet of said Acacia Street bounded on the northeast by a line concentric with and 50.00 feet south- easterly, measured radially, from the centerline of Irvine Avenue, as said centerline is described in a deed to the County of Orange, recorded September 13, 1962, in Book 6247, Page 578 of Official Records in said Office of the County Recorder; and bounded on the southwest by the north- westerly prolongation of the southeasterly line of Lot 72.of said tract. Reserving therefrom a public utility easement to construct, operate and maintain aerial and under- ground public utilities over that portion thereof lying within the southeasterly 10.00 feet of the southeasterly 30.00 feet of said Acacia Street is hereby ordered vacated and abandoned, subject to concurrent action by the County of Orange on the westerly portion of the right -of -way. BE IT FURTHER RESOLVED that the City Clerk is hereby ordered to cause a certified copy of such order attested by the Clerk under the seal of the City 'to be recorded in the Office of the County Recorder of the County of Orange. ADOPTED this 12th day of November, 1979.
