A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH URGING ALL GOVERNMENTAL AGENCIES
PERFORMING WORK WITHIN THE CITY OF NEWPORT BEACH
TO OBSERVE THE REQUIREMENTS OF THE NEWPORT BEACH
GRADING CODE
WHEREAS, uncontrolled and unregulated grading and
movement of earth within the City of Newport Beach can and
does provide a source of silt to the upper and lower Newport
Bay; and
WHEREAS, governmental agencies performing grading
activities within the City of Newport Beach often are not required
to comply with the grading requirements of the Newport Beach
Municipal Code; and
WHEREAS the City Council of the City of Newport Beach
desires to protect the usability and integrity of upper and lower
Newport Bay; and
WHEREAS, silt from uncontrolled grading projects within
the City of Newport Beach causes a significant degradation of
quality of upper and lower Newport Bay and poses a threat to the
very existence of upper and lower Newport Bay:
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that governmental agencies performing
grading operations within the City of Newport Beach are hereby
requested to observe all the requirements of the Newport Beach
Grading Ordinance and Regulations thereunder for the purpose of
reducing as much as possible the entry of silt from said grading
projects into the waters of upper and lower Newport Bay.
BE IT FURTHER
RESOLVED that the City
Clerk is hereby
directed and authorized
to transmit a copy of
this Resolution
to each agency which is
performing grading work within the City
of Newport Beach.
BE IT FURTHER
RESOLVED that the City's
Building Department
representatives be and
hereby are authorized to present a copy

of this Resolution to any governmental agency hereafter per-
forming grading work within the City of Newport Beach who may
not have received a copy of this Resolution by transmittal from
the City Clerk.
