Members Present Robert Hawkins, Chairperson Steve Bromberg Mayor Barry Allen Gary Borquez Gus Chabre Gale Demmer Barry Eaton, Vice Chairman Carol Hoffman Tom Hyans Elaine Linhoff Staff Representatives Sharon Wood, Assistant City Manager Members Not Present John Heffernan, Council Member Laura Dietz The meeting was called to order at 7:00 p.m. Phillip Lugar Jim Miller Marge Pantzar Nancy Raney Richard Rivett Cris Trapp Louis Von Dyl Christopher Welsh Jennifer Wynn Niki Kallikounis, Department Assistant Ray Halowski Richard Oberriter Barry Eaton moved to approve the minutes with a change. A committee member seconded the motion. Motion passes. 2. Discussion of John Wayne Settlement Agreement and Correspondence from the FAA — Robert Burnham, City Attorney Robert Burnham presented a brief history of the Settlement Agreement and noted that the City Council, SPON, the Airport Working Group and the County approved amendments to the Settlement Agreement consistent with Scenario I., which is a 9.8 million annual passenger cap; a 10 -year extension, the term of the Agreement would go out to 2015, although the curfew provisions extended out to 2020; an increase in noise regulated departures from 73 (current level) to 85; passenger departures with an increase of 2 cargo flights, currently there are 2 cargo operations out of JWA and the Board changed Scenario I to make it 4 cargo flights; an increase from the current 14 gates to 18 gates, and the increases in flights and passengers engaged would be effective January 1, 2003. The Agreement that was reached June 25 was reached without input from the FAA or the air carriers. Late in August, as a result of a series of discussions that occurred in the middle of August, the air carriers came to the County and stated they would be willing to support the issuance of a letter by the FAA that would confirm that the amendments are 3. a 5. ��WPOaT CITY OF NEWPORT BEACH �s ENVIRONMENTAL QUALITY AFFAIRS COMMITTEE Approved 02 -14 -03 consistent with the Airport Noise Capacity Act, if some changes were made to Scenario I. The Council, SPON, Airport Working Group and the County collectively determined that an appropriate response to the air carrier offer would be to agree to increase the number of gates to 20; a phased increase in passengers to 10.3 starting January 1, 2003, and 10.8 starting January 1, 2011; and reject the proposed increase in noise regulated departures. The air carriers ultimately accepted that proposal. A request letter to the FAA was prepared, signed by the Airport Director. On December 10"', the City Council, SPON, the County and the Airport Working Group all approved execution of the amended Settlement Agreement to deal with the new passenger cap and the new gates that were authorized. On December 31, 2002, the City received a letter from the FAA, stating that all parties met their requirements in terms of insuring that the amendments and future amendments of the Settlement Agreement would be consistent with and permitted by the Airport Noise and Capacity Act, and that they would not violate grant assurances the County made over time and not violate other Federal laws. Report of Subcommittee on Costa Mesa Plaza Residence Project Draft Environment Impact Report Cris Trapp reviewed the comments from the subcommittee and moved to accept the comments as written and forward the comments to the City Staff, Phillip Lugar seconded the motion. After discussion, the committee made some changes and additions in the comments. Jim Miller offered a substitute motion to delete the comments in the last paragraph in Public Utilities. Gale Demmer seconded the motion. Motion passes. There was some confusion as the clarity of the substitute motion. Jim Miller moved to delete paragraph 4 on page 9. Cris Trapp seconded the motion. Motion passes. One opposed. Barry Eaton moved to approve the document with the paragraph deleted and with the corrections on the noise. Jim Miller seconded the motion. Motion passes. Report from Communications Subcommittee: EQAC Material on City Website Continued to the next EQAC meeting. Report from EQAC Members on GPUC Barry Eaton reported that GPUC has not met in January and reported on the subcommittee meeting. 2 CITY OF NEWPORT BEACH ENVIRONMENTAL QUALITY AFFAIRS COMMITTEE Approved 02 -14 -03 6. Report from EQAC Members on GPAC Phillip Lugar reported that there was no meeting because they are waiting for GPUC. 7. Report on LCP and Information on Subcommittee Chairman Hawkins reported that EQAC has formed an LCP subcommittee. Mayor Bromberg reported that the LCP draft would probably be ready in about two weeks. 8. Council Member Reports Mayor Bromberg reported that he would be making committee appointments at the next Council meeting, and that Richard Nichols will be assigned to EQAC. 9. Public Comments Mr. Friedman, a resident of Newport Beach, addressed EQAC about a noise issue at the Westcliff Plaza 10.
