NOTICE OF PUBLIC HEARING <br />NOTICE IS HEREBY GIVEN that on Tuesday, August 14, 2012, at 7:00 p.m., or soon thereafter as the matter shall be heard, a public hearing will <br />be conducted in the City Council Chambers (Building A) at 3300 Newport Boulevard, Newport Beach. The City Council of the City of Newport Beach <br />will consider the following application: <br />Balboa Village Implementation Plan ( "Plan ") — The Implementation Plan identifies a new vision and direction for Balboa Village. The Plan outlines <br />key steps to be taken over time with the goal of revitalizing the area. The Plan includes the following concepts: enhanced economic development <br />activities, general support for the proposed Balboa Theater and ExplorOcean, a commercial rehabilitation program, modified commercial parking <br />requirements, modification of public parking rates to enhance parking efficiency, enhanced streetscape and wayfinding signs, study of an off -peak <br />season RV use program for the Balboa Pier parking lot, and a possible overnight resioent parking permit program for area between 7th Street and <br />Adams Street. <br />NOTICE IS HEREBY FURTHER GIVEN that the Balboa Village Implementation Plan is exempt from the California Environmental Quality Act <br />( "CEQA") pursuant to Section 15262 (Feasibility and Planning Studies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, <br />because the Implementation Plan only identifies possible future actions and has no legally binding effect. Therefore, adoption of the Implementation <br />Plan itself has no potential to have a significant effect on the environment. Implementation of future actions identified in the Implementation Plan may <br />require environmental review prior to adoption if those possible future actions are defined as a project pursuant to CEQA and could result in a direct <br />or reasonably foreseeable indirect physical change in the environment. <br />All interested parties may appear and present testimony in regard to this application. If you challenge this project in court, you may be limited to <br />raising only those issues you raised at the public hearing or in written correspondence delivered to the City, at, or prior to, the public hearing. <br />Administrative procedures for appeals are provided in the Newport Beach Municipal Code Section 20.64. The application may be continued to a <br />specific future meeting date, and if such an action occurs additional public notice of the continuance will not be provided. Prior to the public hearing <br />the agenda, staff report, and documents may be reviewed at the City Clerk's Office (Building B), 3300 Newport Boulevard, Newport Beach, California, <br />92663 or at the City of Newport Beach website at www.newportbeachca.gov on the Friday prior to the hearing.
