Nearby median and on -street spaces will supplement local needs. To ensure adequate parking for Marina Park visitors, employees and nearby residents, staff requests that City Council: 1. Establish the operating hours of the Marina Park Parking Lots as 6 a.m. to midnight daily; 2. Approve the Marina Park Daily Permit for marina slip renter and Girl Scout participant use, which allows daily and overnight parking at the Marina Park Parking Lots; and 3. Provide for increased Annual Permit parking at Marina Park. Note: It is the City's intent to allow Master Permits to park at Marina Park while using the park, bay beach, or facility. Allowing Master Permits here does not require Council action. RECOMMENDATION: a) Adopt Resolution No. 2015-86, A Resolution of the City Council of the City of Newport Beach, California, Amending Resolution No. 2000-38, to Establish the Hours of Operation for the Marina Park Parking Lots; 5-1 Marina Park Parking November 10, 2015 Page 2 b) Adopt Resolution No. 2015-87, A Resolution of the City Council of the City of Newport Beach, California, Establishing the Marina Park Daily Parking Permit, and c) Adopt Resolution No. 2015-89, A Resolution of the City Council of the City of Newport Beach, California, Amending Resolution No. 2011-109, to Provide for Limited Annual Permit Parking at Marina Park. FUNDING REQUIREMENTS: There is no expenditure of funds related to this item. Staff estimates that if Council approves the Marina Park Parking Lots operating hours and the increase of Annual Parking Permit spaces in Marina Park, revenues from the Marina Park Parking Lots will be between $114,000 to $172,000/year. DISCUSSION: Marina Park The Marina Park project ("Marina Park") consists of two multi-purpose buildings, an open space park, outdoor fitness circuit, children's play area, instructional sailing basin, the future Girl Scout Leadership Center, restaurant, and a 23 -slip transient marina. Parking is required for: • General visitors; • Sailing program participants; • Girl Scouts and Girl Scout volunteers; • Restaurant patrons; • Slip renters; • Recreation class participants; and • Special events. A total of 389 parking spaces are located at the West Parking Lot, Main Parking Lot and East Parking Lot, 15" St., northerly side of W. Balboa Blvd., the W. Balboa Blvd. median, 18th St. and W. Bav Ave. 42 Hours of Operation Generally, most visitors to Marina Park will visit during the daytime, where they can find parking at all the above on -street locations for $1.75 per hour, from 8 a.m. to 6 p.m. From 6 p.m. to 8 a.m., anyone can park on -street without charge. Marina Park Parking Lots will be open from 6 a.m. to midnight to accommodate the comfortable arrival of patrons for early morning recreation classes, as well as evening restaurant patrons, recreation classes and special events. We considered Council's suggestion to open the parking lots at 7:00 a.m. instead, but felt that this could limit 5-3 Marina Park Parking November 10, 2015 Page 4 morning park users' access to the open park, as well as making it challenging for parkers to make it to a 7:00 a.m. class. These operating hours are consistent with other City community centers and support Marina Park operations. Staff recommends charging the standard $1.75 per hour at the Marina Park Parking Lots from 6 a.m. to midnight. Marina Park Daily Parking Permit After midnight, parking will be needed by overnight slip renters and Girl Scout overnight event participants. To ensure parking is available, staff recommends establishing a Marina Park Daily Parking Permit and closing the Marina Park Parking Lots from midnight to 6 a.m. to all parking except for Daily Parking Permit holders. The Marina Park Daily Parking Permit would be valid for 24 hour parking at Marina Park at the Marina Park Parking Lots. The Marina Park Daily Parking Permit would only be available to Marina Park slip renters and Girl Scout Leadership Center participants. Staff recommends pricing the Daily Parking Permits at $21.00 each. However, Marina Park slip renters would receive one free Daily Parking Permit with each paid renter slip per day. Annual Permits (Blue Pole Permits) On October 27, 2015, the City Council heard from concerned residents about the proposed parking at Marina Park and directed staff to provide for Annual Parking Permit spaces at Marina Park. To that end, staff recommends permitting Annual Parking at north side of W. Balboa Blvd. and at 18th St. — this results in an additional 56 spaces. In addition, Annual Parking Permit holders will also be able to park at 10 designated parking spaces in the Main Marina Park Parking Lot and 5 parking spaces in the West Parking Lot. Annual Permit holders can already park at W. Bay Ave and W. Balboa median. Master Parking Permit holders may park at any of the on -street spaces listed above, and may also park at the Marina Park Parking Lots during operating hours. Staff encourages Master Permit holders to park at the Marina Park Parking Lots only when they are using Marina Park facilities. This can be allowed within current regulations, and this action does not require a Council action. Parking is first come first serve. Master and Annual Parking Permits do not have priority over any Marina Park parking spaces. 5-4 Marina Park Parking November 10, 2015 Page 5 Note that recreation class participants receive free parking when they register for classes at Marina Park. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: A. Marina Park also contains three parking lots, West Parking Lot, Main Parking Lot and East Parking Lot, as depicted on Attachment "A" (collectively "Marina Park Parking Lots"); WHEREAS, Newport Beach Municipal Code Section 12.44.030 provides that City Council may establish off-street parking meter zones as traffic and parking conditions require; WHEREAS, the City Council adopted by Resolution No. 2000-38, as amended, which established off-street parking meter zones, including off-street parking meter Zone 20; and established the parking meter hours of operation for Zone 20 as 8:00 a.m. to 6:00 p.m.; WHEREAS, the Marina Park Parking Lots are within off-street parking meter Zone 20; WHEREAS, Marina Park will provide services to the community that will extend until midnight; WHEREAS, the City Council desires to establish the operating hours of the Marina Park Parking Lots to be 6:00 a.m. to midnight at the same hourly rates as the rest of Zone 20 to accommodate Marina Park; and WHEREAS, the extension of operating hours at the same parking rate is consistent with the terms of Coastal Development Permit No. 5-10-229. NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: 5-9 Resolution No. 2015 - Section 1: The City Council hereby amends Resolution No. 2000-38 to establish the parking meter hours of operation for that portion of off-street parking Zone 20 known as the Marina Park Parking Lots, as depicted in Attachment "A", which includes the West Parking Lot, Main Parking Lot and East Parking Lot, to be 6:00 a.m. to midnight, daily. The parking meter hours of operation for the remaining portion of off- street parking Zone 20 shall remain unchanged. Section 2: The recitals provided in this resolution are true and correct and are hereby incorporated into the substantive portion of this resolution. Section 3: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Marina Park also contains three (3) parking lots (Attachment "A"); WHEREAS, Newport Beach Municipal Code Section 12.12.050 provides that no person shall park a vehicle in a City parking lot without paying a fee, if prescribed by City Council resolution, or displaying a City -issued permit authorizing such parking; WHEREAS, the Marina Park marina will provide overnight slip rentals and the Girl Scout Leadership Center will host overnight events; WHEREAS, convenient parking will be required for such rentals and events; and WHEREAS, the City Council desires to establish a daily parking permit to accommodate Marina Park slip renters and Girl Scout participants and volunteers. NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: The City Council hereby establishes the Marina Park Daily Parking Lot Permit, which shall authorize parking at the Marina Park Parking Lots (West, Main and East Parking Lots), as shown on Attachment "A", of the permitted vehicle for 24 hours. Section 2: The Marina Park Parking Lots shall be closed to the general public and all other parking permit holders from midnight until 6:00 a.m. Section 3: The Marina Park Daily Parking Lot Permit shall only be available to Marina Park slip renters and Girl Scout volunteers and participants. Section 4: The Marina Park Daily Parking Lot Permit shall be sold at a rate of $21/day. This fee shall change each year, as provided in Resolution No. 2015-56. Notwithstanding the foregoing, Marina Park slip renters may receive, upon request, one (1) Marina Park Daily Parking Lot Permit without charge for each paid rental slip/day. 5-13 Resolution No. 2015 - Section 5: The Marina Park Daily Parking Lot Permit shall not be usable for vehicles 84 inches or more in width or more than 84 inches in height or more than 20 feet in length. Section 6: The recitals provided above are true and correct and are incorporated into the operative part of this resolution. Balboa Blvd., the W. Balboa Blvd. median, 18th St. and W. Bay Ave.; WHEREAS, the Marina Park Parking Lots consists of 177 new parking spaces within off-street parking meter Zone 20; WHEREAS, the north side of W. Balboa Blvd and 18th St. consists of 56 spaces and are within on -street parking meter Zone 6; WHEREAS, the City Council adopted Resolution No. 2011-109 which established the Annual Parking Permit. The Annual Parking Permit authorizes the parking of a vehicle at, among other locations, off-street parking meter Zone 20 and does not authorize the parking of a vehicle at on -street parking meter Zone 6; WHEREAS, Marina Park will provide services to the community that will require significant use of parking facilities; WHEREAS, the City Council desires to exclude all but five (5) parking spaces in the West Parking Lot and ten (10) spaces in the Main Parking Lot from the Annual Parking Permit use to ensure adequate parking for Marina Park visitors; WHEREAS, the City Council desires to authorize the parking of vehicles with an Annual Parking Permit at the north side of W. Balboa Blvd. and at 18th St. in Zone 6; WHEREAS, Annual Parking Permit holders may also continue to park at W. Bay Ave. and W. Balboa median.
