The whole idea of the RFP -15-55 was to create more affordable housing within Newport Beach. This removes 12 units and replaces those 12 units. The next effect is not zero — it is less than zero, because we will remove affordable housing needed for entry level employees or civil servants or public service employees from the housing stock of West Newport Beach. There were more than 65 Newport Beach residents in attendance. The developer was represented as was Mercy House and the current owner through their broker. We had hoped to have City Council members and Affordable Housing Committee members attend, but no one attended. Here are some reasons why I feel you need to vote against the proposed RFP -15-55 REASON 1) IT IS INCOMPLETE —THE DEVELOPERS MADE PROMISES TO THE 65 MEETING ATTENDEES THAT MUST BE ADDED TO THE "CONDITIONAL USE PERMIT" BEFORE APPROVAL As one might predict, at the meeting, there were some who were emotional and potentially misinformed as to what the project was about. However the developer and Mercy did not do themselves any favors in some of their comments. The developer and Mercy House kept changing their minds on the spot, and they made promises to the group — promises that make it impossible for the Newport City Council to vote on the project on 11/24, because they 1 said their promises would be put into writing as part of a "Conditional Use Permit" and the City of Newport Beach would be empowered to put a lien on the property if any promise was broken. For example, these are some of the items that were promised to residents to be included in the "Conditional Use Permit" • The property could not be sold for 15 years • The property could not be used for anything other than senior housing for 55 years • if a resident commits a felony he/she would be evicted from the property • no pedophiles will be allowed • no drug addicts will be allowed • no more than two people per unit • there would be one psychologist, counselor, representative or manager living on site (this title kept changing) • 4 units for seniors • 6 units for vet o NOTE: They later said that they would limit the tenants on only vets age 65 and older— I guess seniors sounded good and vet sounded good, so senior vets over 65+ sounded better In other words they over committed and over promised to the 65+ residents, who now want to make sure that the City of Newport Beach backs up in writing in a draft Conditional Use Permit, before the City of Newport Beach approves any loans or any affordable housing funds or any construction permits REASON 2) THIS PROJECT IS TOO SMALL TO MEET THE CITY'S OBLIGATIONS FOR AFFORDABLE HOUSING At the meeting the developers reviewed that they asked for $1.4 million because this is all that they needed. The developers basically said that the staff of the City of Newport Beach, forced them to increase the project costs, so the amount of $1.9 could be justified. The reason to inflate the project costs was to make the project eligible for State of California funds. The benefits are twofold: 1) we get money from the State of California, which feels good since we pay so much in taxes and 2) The Affordable Housing Department of California can then enforce state laws on the property and save the city enforcement hassles. Although the two benefits seem nice, there is the core problem that the project really is too small and does not bring the needed affordable housing. Is it legal for the city to inflate the project in concert with the developer just to access State of California funds? Maybe the developers were nervous and did not clearly communicate. However, the benefits for Newport Beach as a city are not as attractive as they should be — ie this is a poor investment. These neighbors are not emotional. They are reviewing the General Plan and discovering the Housing Element and trying to make sense of how the city allowed this project to get this far without sharing and without outreach by the City of Newport Beach — this is not just a developer issue —Affordable Housing is a City of Newport Beach issue, so the City of Newport Beach should have done outreach when the project was submitted for the RFP REASON 3) HAVING THE VOTE ON SUCH A CONTROVERSIAL ISSUE DURING THE WEEK OF THANKSGIVING MAKES RESIDENTS SUSPICIOUS Tonight is Monday before Thanksgiving and 65+ residents showed up from a community of roughly 400 houses and with a large majority of families traveling this week. Many people came because only learned about the project when someone saw it on the City Council Agenda. West Newport residents fear that this is just one step in the direction of rezoning larger parts of West Newport for other hot potatoes that the City of Newport Beach might want to toss around. There is a general feeling among residents in West Newport that the City Council does not value nor respect them as residents. For newcomers on the City Council let me provide some recent sources of those feelings and their relevance: • During the West Newport "Rehab Wars" residents learned two things: 3 o 1) Newport Beach will not enforce its own laws and conditional use permits in West Newport, unless residents get very involved in collecting data, evidence and writing to and calling and meeting with City Staff and City Council — being our zoning enforcement and law enforcement is very exhausting and we are reluctant to accept any new situation where we, the residents, have to be our own enforcement agency o 2) Newport Beach is afraid of any situation where someone claims being a "protected class" and as a result the city is willing to sacrifice large groups of residents before taking on any situation where someone claims "protected class" even when that party is wrong. This project involves the city supplying funds to a contractor for the purpose of filling 12 units with affordable housing tenants most of whom can claim "protected class". When the developer says we can depend on city enforcement of the Conditional Use Permit, it brings concerns. • When the City of Newport Beach planned on moving the City Hall to the new site, West Newport residents were promised amazing public use potential of the old City Hall site. Once the New City Hall was in place, the City Council conveniently forgot their promises of rec centers or converting the council chamber into a theater and other public uses for our children and grandchildren. Instead the City Council voted to donate the land to a hotel. RD Olsen is making a nice hotel. RD Olsen was also reported as paying more than $1 million into the Affordable Housing fund rather than offer affordable housing — ironically this money is the money being requested for this controversial project. • When the City Council voted to approve Banning Ranch, we thought they approved the best deal for West Newport. However through the California Coastal Commission Staff we learned that many aspects of the City Approved project were illegal and that the owners already had a plan 35% smaller that would have been offered if the City of Newport Beach sought the best deal for West Newport residents. Why did the City not push for the best deal for West Newport residents when approving Banning Ranch? Why is not part of the $4 million Affordable Housing funds being saved to add more units of affordable housing in Banning Ranch? REASON 4) THE OTHER PROJECTS ARE BETTER The developers said that there were other projects competing for the same funds. I had the impression from the way they presented that Oasis is a better project and better use of the $4 million in the Affordable Housing funds. Some asked why the $4M could not be used for affordable housing in the new Banning Ranch development. REASON 5) WRONGFULLY WRAPPING THEMSELVES IN THE FLAG AND USING OUR CITY'S HONOURABLE DEDICATION TO VETS TO GAIN VOTES ON A PROJECT WHERE VETS DO NOT BENEFIT During the meeting, it became clear that the developers and Mercy House do not understand Vet issues and are not prepared to deal with them. They kept changing their mind, and when they got lost in their own discussions. They simply said that "vets are heroes" I have a daughter serving with her husband in the Air Force in South Korea. I found it insulting that the representatives of this project would use the slogan "we can do this for vets" in public without really having a plan. They used words like "if" "maybe" "we should" - They had no conviction. They had no developed plan to help vets. If they actually had a plan and actually had approval from the VA then they so fumbled the ball in their presentation as to convince me there is no plan. Just hope — a hope that if they use the "we can do this for vets" that the City Council will blindly vote yes and maybe they can contact the VA and maybe that can actually arrange something.... maybe. PLEASE DO NOT VOTE FOR THIS PROJECT UNLESS THE PLAN TO SERVICE VETS IS IN WRITING AND THE SERVICES ARE CLEARLY WRITTEN IN THE CONDITIONAL USE AGREEMENT. It would dishonor our vets to allow someone to use invoke how their project will benefit vets and the City Council not secure in writing very strong language that makes sure those benefits are real. 4 I am sorry that my comments were long, but no one from City Council nor from the Affordable Housing Committee came to our community meeting, and I wanted to share with you what you missed. What feel West Newport still has the spirit of old Newport. We appreciate living in Newport Shores, which is one of the remaining old Newport areas. But 'old Newport' shouldn't be thought of as inferior or as the slums. Many of our neighbors are families , nature loving people who appreciate the beach, ocean swimming, biking and surfing. A recent visitors Newport Beach magazine that I picked up while visiting my sister on Balboa Island spoke of Newport Beach as 'home to surfers and surf executives, families and the famous — and it's a point of pride that often you can't tell the difference between them. ' I hope the present NB City Council will appreciate the diversity of Newport Beach when they consider using $1.9 million dollars of restricted funds to ugrade an apartment building behind Cappy's cafe off PCH and to remove the current tenants, including a wonderful man who used to own homes in Newport Shores, but is now on disability and who could not afford renting near our beaches. Why kick them out & put in other 'low income' renters? It doesn't make sense for the city of NB to spend $1.9 million of city funds, & to spend over $100,000 on each of 12 apartments while doing superficial upgrades and removing renters who might also be considered 'lower income' in Newport. It is a benevolent idea to provide low income housing when developers benefit from building high end projects. But why aren't they integrated into new projects like Banning ranch or Newport Coast or areas near the airport? West Newport and Newport Shores doesn't have the charm of Corona Del Mar or Balboa Island or Bayshores or the glitz and glamour of other areas in Newport, but it does have authenticity and appreciation for a lagoon with a habitat for blueherons, egrets , pelicans and a way of life that has almost vanished from Newport Beach. I trust the integrity of our elected officials to rethink this decision and to continue communicating openly with all of the residents of Newport Beach. I don't think a decision should be made until further discussions can be done. Unfortunately we can't come on Tuesday for the meeting because we are leaving town for the holiday. I'm not sure why you would consider putting low income housing in Newport Shores. We are proud of our community and don't want to see property values going down. There are many other areas that are more suitable and we don't want to see a trend happening to us here. The same values should be shown to us as the rest of Newport Beach and not have matters of this type just thrown at us with no notice. It seems like West Newport is always on the low end of the stick for the city and we don't appreciate it. A few questions come to mind. 1. Does Mercy House have other projects in Newport Beach area that they are in charge of? 2. Are these family oriented units being constructed? 3. We already have low-cost housing in our area. We have a trailer park, modular housing, and Pineknot hotel. 4. Are the people in the housing complex all employed and working? 5. Is it in the master plan for this area to have this type of housing? Or is this a last minute effort to comply to state mandate? 6. I live in the neighbor hood and this is a very bad location for this project. It is right next to a park that families and toddlers frequent. I am all for low income projects but there are better places; for example by the airport. We are fighting to upgrade our area!!! It is in everyone's best interest in Newport Beach to work on elevating West Newport's desirability to live. PLEASE vote NO for this project. Not that anyone on the city council really cares what the citizens think, it is now all always has been all about greasing the skids for the developers and any project that will add a few dollars the the coffers. Using almost $2,000,000 of city funds to make this happen and not telling the public is incredible but not surprising given the recent history from the new city hall debacle to pushing Banning Ranch down everyone's throat. Yet again the City has tried to make sure a development will fly under the radar by not giving adequate notice, a tactic used several times over the years.always with the same weak excuse that it is the developers responsibility. We look forward to the City Council meeting. Gary Reasoner 259 62nd St. ATTENTION NEWPORT SHORES RESIDENT VERY LOW INCOME HOUSING PROPOSED IN NEWPORT SHORES I wanted to make sure you are aware COMMUNITY DEVELOPMENT PARTNERS (The Developer) has requested money from the City of Newport Beach to convert the 12 unit apartment building at 6001 Coast Blvd. (in back of Cappy's Cafe and next to the park) to "affordable housing" for residents with "special needs". If this project moves forward the property will be restricted to this use for the next 55 years. What is "affordable housing" and what are "special needs"? The City of Newport Beach defines "affordable housing" as: An ownership or rental -housing unit, including senior housing, affordable to households with very tow (Income 50% or less of the Orange County median income)-, low (Income between 50% and 80% of the Orange County median income) -, and moderate (Income between 80% and 120% of the Orange County median income) - incomes (The Developer is proposing net monthly rents ranging from $661 to $1,012 (no voucher) for a 1 bed 1 bath unit). The City of Newport Beach (General Plan Housing Element) defines "special needs" as: students, persons with disabilities, persons with developmental disabilities, , female head of household, seniors, large households, the homeless and farm workers. The Developer realizes people with "special needs" require support services and is partnering with MERCY HOUSING for off-site support services. The Developer wants to limit tenants to veterans and tenants with special needs — a worthy cause. However, federal and state anti discrimination laws do not allow this restriction. Therefore, this project will provide low income rental housing for the full range of special needs for the next 55 years. Is this the right location for a low income special needs rental housing project? Newport Beach is a great City and I believe Newport Beach residents should do their fair share to help those with special needs. However, I do not believe this is the right location for a low income special needs housing project that does not have on-site special needs services. The City of Newport Beach Affordable Housing Task force recommended approval of $1,975,000 of City funds to make this project a reality. This is $475,000 more than the Developer asked for. WHY? These types of projects are hard to locate. The City wants to do this to Newport Shores! WHY? They are not being forced by state, federal or court action. Two days before Thanksgiving, the City Council will hold a public hearing on November 24, 2015 at 7:00 p.m. (City Council Chambers at 100 Civic Center Drive, Newport Beach) and presumably take action on this project. The City is noticing property owners within 300 feet of the subject property. With the exception of several houses on 61" and surrounding businesses, no one will receive written notice of the hearing! WHY? According to the City, it's the Developers responsibility. In their request for City funds COMMUNITY DEVELOPMENT PARTNERS told the City: "As with all our projects, CDP will actively engage the community for input and to address concerns the regarding Newport Shores project. We would work closely with the City of Newport to organize outreach sessions as efficiently and effectively as possible. " (Source: Community Development Partners proposal, Section G. Community Outreach) Has the Developer contacted you? No, why not? The Developer has a City recommendation for approval. Why does the Developer or City need to rock the boat? They don't, these are difficult projects to locate. As it sits now, without your voice the City intends to approve this project. Is this what you want in Newport Shores? If not, you need to speak up! If you do not think this is the right place for drug addicts, the homeless, alcoholics, felons, sex offenders, etc., especially without on-site supervision and for individuals who can't afford to live in Newport Shores even if we subsidize their housing costs, contact our City fathers, ask them what they are thinking and tell them to say NO! Not only do we have deal with the parking issue with just residents and their guest staying here, we have guests from the Holiday Inn and Pine Knot Motel parking on the street. During the summer breaks, it is impossible to find parking on the streets with the tourist and visitors going to the beach and parking free in our neighborhood. The traffic can be hazardous with people rushing up and down the street trying to find a parking space and hitting resident's car. I can show you the four dings and scratches that my car has gotten this year by drivers who cannot parallel parking. (my car is not even a year old). Not only that I have noticed many of the current residents at the location have their garage used for storage and park on the street I understand that you may feel this low income housing is necessary, but there are other areas closer to Costa Mesa that can better suit the needs of very low income people. This area is not suitable for people who may not have transportation to and from doctor's appointment, markets and job opportunities. We still have homeless people walking around the housing areas and many car break ins. The city police send out notices every spring and summer breaks to look out for suspicious people.
