Ordinance No. 2021-1 <br />Page 4 of 6 <br />Section 1: The City Council has considered the recommendation of the <br />Planning Commission and the Parks, Beaches and Recreation Commission and <br />determined that modifications to the Project made by the City Council, if any, are not <br />major changes that require referral back to either commission for consideration and <br />recommendation. <br />Section 2: The City Council hereby approves Planned Community <br />Development Plan Amendment No. PD2020-001, an amendment to Planned Community <br />Development Plan #15 (Koll Center Newport Planned Community) as depicted in Exhibit <br />"B", which is attached hereto and incorporated herein by reference and finds that Planned <br />Community Development Plan Amendment No. PD2020-001 complies with the purpose <br />set forth in Section 20.56.010 (Purpose) of the NBMC. <br />The amendment to the Planned Community Development Plan #15 (Koll Center <br />Newport Planned Community) meets the intent and purpose of Section 20.56.010 in that <br />the Residential Overlay Zone provides for the classification and development of 260 <br />additive residential units consistent with the goals and policies of the MU -H2 (Mixed -Use <br />Horizontal 2) land use designation and the ICDP along with a 20 percent density bonus <br />of 52 units for a total 312 residential units, while maintaining the business and professional <br />office park environment. <br />The Residential Overlay Zone is tailored for the Project and includes density, <br />intensity, and development standards such as building height, setbacks, and parking. It <br />also includes general provisions for on-site circulation, loading, landscaping, signage, <br />lighting, and recreation and open space requirements to ensure the Project will be <br />compatible with the existing office developments within Office Site B; and <br />Future development of the Property affected by the proposed amendment will be <br />consistent with the goals and policies of the Land Use Element of the General Plan along <br />with the purpose and intent of PCDP Amendment. <br />Section 3: The recitals provided in this ordinance are true and correct and are <br />incorporated into the substantive portion of this ordinance. <br />Section 4: If any section, subsection, sentence, clause or phrase of this <br />ordinance is for any reason held to be invalid or unconstitutional, such decision shall not <br />affect the validity or constitutionality of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each section, <br />subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses or phrases be declared invalid or <br />unconstitutional. <br />
