3 VvMREAS, pursuant to instructions, the City Attorne�
4 of the City of Newport Beach has prepared a contract in which the
5 City of Newport Beach agrees to sell certain excess water of said
6 City of J. A. BEEK and L. W. BRIGGS, upon the conditions, covenant
7 and restrictions in said contract set forth; and
8 WHEREAS, said contract has been duly presented by
9 said City Attorney to the City Council of the City of Newport
10 Beach for its acceptance and approval.
11 NOVI, THEREFORE, BE IT RESOLVED: That that certain

12 contract made and entered into the 24th day of March, 1931, by
13 and between the City of Newport Beach as the party of the first
14 part, and '1J. A. BEEK and L. W. BRIGGS, as the parties of the
15 second part, and wherein and whereby the City of Newport Beach
16 agrees to sell certain of its excess water upon certain conT-
i7 ditions, restrictions and limitations to said parties of the
18 second part, be and the same is hereby approved as written.
19 BE IT FURTHER RESOLVED: That the Mayor and City
20 Clerk of the City of Newport Beach be authorized and directed-to
21 sign said contract on behalf of said City of Newport Beach.

23 I hereby certify that the foregoing resolution was
24 duly and regularly passed by the City Council of the City of
25 Newport Beach at an adjourned regular meeting thereof, held on
the 6th day of April, 1931, by the following vote, to —wit:
