RESOLUTION NO. 719
• WHEREAS, there has this day been presented to the
City of Newport Beach, a certain agreement dated the 12th day of
November, 1931, by and between the Southern Pacific Company,
a corporation, inEndd agreement termed "Licensor ",and The City
of Newport Beach, a Municipal Corporation, in said agreement
termed, "Licensee "; and
WHEREAS, in said agreement the Southern Pacific
Company permits Licensee, the City of Newport Beach, to construct
reconstruct, maintain and operst a an eight inch (i") corrugated
iron pipe, in said agreement termed, "Structure ", for conveying
drainage, said structure to be constructed beneath property of
Licensor, at a depth specified by Licensor, at or near Newport
Beach Station, Councty of Orange, and State of California, in
the location as shown in red on blue print map attached to
said agreement, and more particularly described as follows:
From a point in theeasterly right of way
line to a point in the westerly right of way line and
crossing not less than three feet below base of rails.
NOW, THEREFORE, BE IT RESOLVED: That the terms of
said agreement heretofore mentioned be approved and that said
agreement be accepted as presented; and
BE IT FURTHER RESOLVED: That the Mayor of the
City of Newport Beach be and he is hereby authorised and directed
to sign said agreement in duplicate on behalf of said city of
Newport Beach, and that the Clerk of the City of Newport Beach be,
and he is hereby authorized and directed to attest said agreement
• and affix the seal of said City of Newport Beach thereto, said
agreement so executed to be sent by the Clerk of said City of

Newport Beach to said Southern Pacific Company for their
signature and upon the return of said agreement duly executed
by the Southern Pacific Company, the same to be filed.
I hereby certify that the foregoing Resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at a regular meeting thereof held on the 23rd day
of November, 1931, by the following vote, to —:pit:
